What is Mediation?

Mediation is the process of bringing together parties who are in a dispute. A trained mediator allows the parties to find a solution that avoids the cost and uncertainty of litigation. 

   Mediation is:

  • Private
  • Confidential
  • Impartial
  • Explores what a fair, practical and lasting resolution can be.
  • Faster than litigation
  • Less expensive than litigation
  • Binding

NO matter how big or small the dispute is, in mediation you have a say in the outcome.

If Your Dispute Goes to Court

  • A judge or a jury decides the outcome instead of you.
  • You have to prove your case
  • In court there is no middle ground; you “win” or you “lose”.
  • Both parties in a dispute KNOW that they are right, BUT many parties are surprised to find out in court that the judge or jury sees it differently.

Early involvement of a qualified mediator can eliminate growing animosity and legal fees that can prevent a satisfactory resolution for both parties to the conflict.

 By participating in a mediation and with a little education, you can make a decision that’s right for you in your situation no matter how big or small the conflict.
